Terms of Service

1. Platform Description

Momentra operates a technology platform that enables photographers to upload and sell event photographs and enables athletes and participants to discover and purchase those photographs. Search tools may include event search, bib number search, and optional recognition tools.

Momentra does not create, own, or control most photographs made available through the platform. Momentra acts as an intermediary technology provider connecting photographers and buyers.

2. User Accounts

Users must create an account to access certain features. Users agree to provide accurate information, maintain credential security, and remain responsible for actions taken under their account.

Momentra may suspend or terminate accounts for violations of these terms, fraudulent activity, platform misuse, or abuse of search and recognition tools.

3. Photographer Accounts

Photographers may create specialized accounts to upload and sell images. By uploading content, photographers represent that they own the copyright or have legal rights to the images, have permission to photograph the event, and are not violating privacy, publicity, or intellectual property rights.

Momentra may approve or reject photographer accounts, remove images, or suspend photographers at its sole discretion.

4. Marketplace Relationship

Momentra operates as a marketplace platform. Transactions occur between photographers and buyers. Momentra facilitates hosting, discovery, payments, and digital distribution, but is not responsible for disputes between photographers and buyers.

5. Payments and Stripe Connect

Payments may be processed through Stripe or other third-party processors. Photographers receiving payouts may use Stripe Connect accounts and agree to applicable Stripe agreements. Momentra does not control payment processor policies and may collect service fees or commissions.

6. Digital Photo License

Purchasing a photo grants a limited personal license to download and use the image for personal purposes. Unless otherwise specified, buyers may not resell, commercially exploit, or redistribute the image without permission. Commercial rights must be negotiated with the photographer.

7. Biometric and Image Recognition Tools

Momentra may offer optional tools such as facial recognition search, bib number recognition, and automated photo indexing. These tools are intended solely to help users locate photos and are not guaranteed to be accurate. Use of facial recognition features is voluntary.

8. Event Photography Disclaimer

Images on Momentra may contain participants photographed during public sporting events. Users acknowledge that photography is common at such events and that participants may appear in publicly distributed photos. Momentra acts only as a distribution platform.

9. Content Moderation

Momentra may remove or restrict access to content because of copyright complaints, privacy complaints, policy violations, or abuse of the platform.

10. Prohibited Use

• Scraping or downloading large volumes of photos
• Reverse engineering platform systems
• Misusing facial recognition or search tools
• Uploading unlawful, abusive, or infringing content
• Interfering with platform infrastructure or availability

11. Limitation of Liability

To the fullest extent permitted by law, Momentra is not liable for indirect damages, lost profits, lost data, system outages, recognition inaccuracies, or disputes between photographers and buyers. Use of the platform is at your own risk.

12. Service Availability

Momentra does not guarantee uninterrupted availability. Maintenance, outages, and service changes may occur from time to time.

13. Termination

Momentra may suspend or terminate accounts at its discretion, including where continued access would create legal, security, or operational risk.

14. Governing Law

These terms are governed by applicable law based on Momentra's operating jurisdiction.

15. Changes to Terms

Momentra may update these terms from time to time. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
